Trump "has threatened the constitutional system by instigating the revolt and his conduct must be declared unacceptable in the clearest and most absolute terms", the team affirms, underlining how the former president "should be prohibited from holding future public office". And the document continues: "President Trump's effort to extend his hold on power by fomenting violence against Congress was a profound violation of the oath he swore. Whether to provoke an insurrectionary uprising against a joint session of Congress after losing a 'election is not a crime subject to impeachment, it is difficult to imagine what it could be ".
However, it seems unlikely that the trial of Trump's second impeachment could end with a sentence: the Democrats would need the votes of 17 Republican senators. Last week 45 of the 50 Republicans in the Senate passed a motion to affirm the unconstitutionality of an impeachment trial against a president who is no longer in office. Prosecutors argue that there are no exceptions to impeachment: a president is prosecutable until the last day of his mandate, and Trump was still president when he committed the crime for which the trial was initiated.
