Legal Blow to Meghan Markle: 17-Month Battle to Trademark 'Archewell' Annulled as Lawsuit Looms

Meghan Markle has decided to abandon her 17-month-long battle to trademark 'Archetypes' amidst the looming threat of a lawsuit from another company. The Duchess withdrew her trademark bid for fear of potential legal action. 

This move comes after her multi-million-pound Spotify deal faced cancellation earlier in June when it was announced that the 'Archetypes' podcast would not be renewed for a second season. Sources linked to the £15 million deal signed by the couple in 2020 revealed that it was axed due to insufficient content production, with Spotify executive Bill Simmons going as far as describing Meghan and Harry as "grifters." 

Despite the Spotify deal's demise, Meghan had attempted to revive her trademark bid for 'Archetypes,' but this application has now been officially withdrawn following an unsuccessful 17-month struggle to protect the name.

Meghan's endeavor to trademark 'Archetypes' commenced in March of the previous year when the initial application was filed. However, in January, the US Patent and Trademark Office (USPTO) rejected it, citing potential confusion with an existing trademark bearing the same name. This prior trademark for 'Archetypes' had been registered in May 2018 by a US-based company called Project Miracle IP Holdings.

 They registered it for the purpose of providing online content such as blogs, non-downloadable publications, articles on various subjects including nutrition, fitness, psychology, relationships, dating, and more. The obstacle faced by Meghan's trademark application stemmed from her inability to provide tangible examples of its usage in each class of service, a requirement for trademark registration. The lack of evidence appears to have led to the withdrawal of the application.

It raises questions about whether Meghan and Harry will be able to fulfill these requirements within the next six months, as they have struggled to do so over the past two years of extensions. Some predict a potential rebranding attempt, given the apparent difficulties in meeting the necessary criteria for trademark registration. 

This recent development underscores the challenges faced by Meghan Markle in the pursuit of trademarking 'Archetypes' and the consequences of her actions on various fronts, including her professional endeavors and public perception.
